DISPOSAL OF INSTRUCTIONAL MATERIALS

“The Commissioner rules are posted on the Texas Register for public comments. It contains proposed rule text for the sale and disposal of instructional materials. While the rules have yet to be finalized, it does provide additional guidance for the sale and disposal of instructional materials. Our recommendation at TEA is to wait until the rules become final to ensure districts follow the Commissioner’s approved process.”

ABOUT CMD (LEGAL)

On page 6 it speaks to the manner is which we are able to sell printed instructional materials on the date they are discontinued for use in the public schools by the SBOE or the Commissioner.  That is to say once they are out of adoption, we can sell them.

 On page 7, at the very bottom, it states "Under no circumstances shall a district sell out-of-adoption materials."

 I called the legal department at TASB and spoke to an attorney about this and she stated that it appears the TEC and TAC statutes conflict each other.  She also stated she would send out an e-mail to her peers and try to get some resolution and call me back.

While waiting for the call from TASB, I called John Lopez to inquire about it also.  He stated that TAC had not been updated yet after the last legislative session but it was in the works.  He said that it was scheduled to be done by the end of June and until that time, we should follow the TEC which says we can sell them.  After June, they should say the same thing.

As soon as I hung up with him, TASB called back and said the same thing but she did not know when it was scheduled to change.

Texas Education Agency - Administrative Rules

The rules adopted by the State Board of Education (SBOE) and the Commissioner of Education are part of a larger body of state agency rules known as the Texas Administrative Code (TAC). These rules are collected and published by the Office of the Secretary of State. SBOE and commissioner's rules are codified under Title 19, Part II, of the TAC. Title 19 is Education, and Part II is the Texas Education Agency. The SBOE and the Commissioner of Education may adopt new rules or amendments to existing rules.

TEX-009 & TEX-012 Reports Available in EMAT

The TEX-009 report is available in EMAT for districts and open-enrollment charter schools to report only EVI materials that have been lost or damaged by students.

The TEX-012 report is available in EMAT for districts and open-enrollment charter schools to report inventory adjustments.  Districts will complete the TEX-012 to report EMAT/EVI materials that are lost, damaged, or destroyed by fire, flood, stolen, and student illness.  TEA staff will review and approve the transaction and the materials reported will be removed from your inventory.

LARGE PRINT AND BRAILLE RETURN

On November 21, 2011 an option for shipping surplus Braille and large type instructional materials to the Special Textbook Redistribution Center (STRC), will be available.  This option is located on every school district and charter school’s Start Page in the “EVI” section.

The Special Textbook Redistribution Center (STRC) will accept surplus Braille and large type instructional materials through April 30, 2012

CaTE COURSES
updated May 2010

In July 2009, the State Board of Education (SBOE) adopted newly revised Texas Essential Knowledge and Skills (TEKS) for career and technical education (CTE). The new TEKS reduce the number of courses from 607 to 194, update technical and academic content, increase rigor and relevance, imbed college and career readiness standards, and align with the nationally recognized 16 career clusters. Districts must implement these new courses with the 2010-2011 school year.

Since new instructional material for the CTE courses will not be available to districts for several years, the Texas Education Agency is allowing districts to request CTE materials that were adopted in 2003 under Proclamation 2001 that correspond to the new courses. Please use the attached list (updated May 2010) to determine whether currently-adopted materials are suitable for use with the new courses. This information will also be available at http://ritter.tea.state.tx.us/textbooks/announcements.
